We reserve the right to close or suspend your Sticitt Pay account if we are unable to verify your information, are unable to comply with anti-money laundering regulation or suspect illegal activity associated with your Sticitt Pay account.
To create or access your Sticitt Pay account you will be verified by either verifying your mobile number through an OTP verification process or by password associated with your mobile number or email address. Where Sticitt Pay is offered through a partner’s mobile application, Sticitt will use tokenised authentication for future transactions once the initial authentication process has successfully been performed. Where Sticitt Pay is used through web applications you can opt to perform tokenised authentication for future transactions once the initial authentication process has successfully been performed.
Your Sticitt Pay account is used to authorise and perform payment for products and/or services from registered Merchants using Sticitt Pay credits. Payment for products and/or services from registered Merchants can only be performed if sufficient credits are available in your Sticitt Pay account. Credits in your Sticitt Pay account is topped up through making an electronic funds transfer or cash deposit to the default Sticitt Pay bank account held at FNB using your dedicated Sticitt Pay account reference (“top-up”). Sticitt reserves the right to deduct all direct bank costs, incurred by Sticitt associated with a top-up of your Sticitt Pay account.
Currently, South African Rands are the only accepted currency for top-up purposes and it will take between 30 minutes and 48 hours for credits to reflect in your Sticitt Pay account from when the top-up was performed. The default Sticitt Pay banking details can be viewed in the Sticitt Pay mobile or web payment interface, accessible through previously paid payment requests or through our partner mobile applications and/or account management services, whichever is applicable or by sending an email to firstname.lastname@example.org.
For added convenience, Sticitt offers instant top-ups that enable purchased credits to immediately reflect in your Sticitt Pay Account (“Instant top-up”). Sticitt reserves the right to charge an administration fee for Instant top-ups, which fee will be clearly communicated and disclosed prior to the processing of an Instant top-up. To perform Instant top-ups, you can add a debit or credit card, issued under the VISA or Mastercard card association, to your Sticitt Pay account through the Sticitt Pay mobile or web payment interface, accessible through previously paid payment requests, our partner mobile applications and/or account management services or our Sticitt Pay mobile application, whichever is applicable. By adding a card you provide Sticitt with authority to continuously charge that card to process Instant top-ups. You can remove this authority by removing that card from your Sticitt Pay account through the same process followed when adding that card.
To increase the security of your card transaction Sticitt has partnered with Visa and Mastercard and performs an authentication process through your bank the first time you add a new card. Sticitt never stores your card details and complies with all applicable data protection and privacy laws including the Payment Card Industry Data Security Standards (PCI DSS). Nedbank acts as Sticitt’s acquiring bank for all card processing and transactions are processed through the iVeri payment gateway. For more information visit www.iveri.com.
Sticitt Pay includes the functionality to link a physical token to your Sticitt Pay account through the Sticitt Pay mobile or web payment interface, accessible through our partner mobile applications and/or account management services or our Sticitt Pay mobile and web applications, whichever is applicable. Physical tokens are offered in various form factors and include, but is not limited to cards and bracelets with the official Sticitt Pay logo printed on the face of such card or bracelet (“Sticitt Pay Token”). Sticitt Pay Tokens are obtained from registered Merchants or Sticitt and linked to your Sticitt Pay account using the 16 digit hexadecimal code allocated to each Sticitt Pay Token. Additionally, a picture, name, daily spend limit and note can be added to each Sticitt Pay Token linked to your Sticitt Pay account, which information will be displayed on the Pay Terminal where the Sticitt Pay Token is presented for payment for products and/or services from registered Merchants.
Sticitt will not be held liable for any losses arising from incorrect payment references used during top-up and for the avoidance of doubt, Sticitt will not accept any responsibility for any losses arising from top-ups made to bank accounts different to the bank account details referenced in the Sticitt Pay Overview section above. It is the users responsibility to ensure these details are captured correctly during top-up and the user indemnifies Sticitt against all losses arising from top-ups to any other bank accounts. Purchases initiated but not paid due to insufficient credits in your Sticitt Pay account will be cancelled after 4 full days (96 hours) from the date of first purchase instruction.
Any Sticitt Pay Token linked to your Sticitt Pay account can be blocked and unblocked at any point in time and it remains your responsibility to ensure no unauthorised use of a Sticitt Pay Token linked to your Sticitt Pay account occurs and Sticitt will not be held liable for any losses arising from any such unauthorised use.
In purchasing products and/or services from any Merchant, you are contracting with the relevant Merchant and the Merchant is thus solely responsible for the fulfilment of all aspects of your purchase. Sticitt Pay Merchants contract with Sticitt and agrees that no products and/or services purchased using Sticitt Pay credits may be exchanged for cash. Refunds of Sticitt Pay credit can only be processed if such refund request is logged and accepted with and by the applicable Merchant and Sticitt within 48 hours of the applicable successful transaction. Following this, all refunds to be arranged between you and the Merchant directly. Sticitt only performs authorisations and payments for products and/or services offered by Merchants and accepts no responsibility for delivery of products and/or services and you indemnify Sticitt against any losses arising from products and/or services incorrectly delivered or not delivered at all.
The Sticitt Pay service is provided “as-is” and without any representation or warranty, whether express, implied or statutory. Sticitt specifically disclaim any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement.
Sticitt’s liability is limited with respect to your use of Sticitt Pay and any associated services. Sticitt will not be liable for any losses arising out of or in connection with Sticitt Pay (including any networks and servers used to provide the Sticitt Pay service) operated by us, unless and to the extent prohibited by law.
Sticitt Pay Tokens are used at own risk and Sticitt will not be held liable for any injury or losses arising from your use or others’ use of Sticitt Pay Tokens linked to your or others’ Sticitt Pay account.
Sticitt is not a bank and is not acting as trustee, fiduciary or escrow for funds paid to perform Sticitt Pay account credit top-ups, we are acting only as a custodian of your account credits. Sticitt Pay credits are not cash and are solely for the purchase of products and/or services from Sticitt Pay Merchants. Funds paid to top-up your Sticitt Pay account credits will not be used for Sticitt’s operating expenses or general corporate purposes and Sticitt will not voluntarily avail these funds to creditors or in bankruptcy proceedings.
Sticitt Pay credits can only be redeemed for cash through sending an email to email@example.com with a clear photo of your ID document and proof of bank account details where payment must be made to. Sticitt reserves the right to charge a redemption fee when Sticitt Pay account credits are redeemed for cash which fee might change from time-to-time but will be communicated to you prior to redemption.
Sticitt reserves the right to withhold any purchase of products and/or services and suspend Sticitt Pay accounts if any suspicion of fraudulent activity is present. You acknowledge that Sticitt may access your personal information from applicable partners that Sticitt has entered into an agreement with to enable the Sticitt Pay offering.

This Merchant Agreement is agreed between any natural or legal person accepting payments made through Sticitt’s Payment SDKs and/or Pay Terminal as a valid payment option for goods or services offered by such natural or legal person (“Merchant”) and Sticitt (Pty) Ltd (“Sticitt”). We may amend this Agreement by posting a revised version on our website, at which point the posted revised version will be effective.
In this Agreement, unless a contrary intention clearly appears -
This Agreement shall continue in full force and effect for so long as the Parties continue to conduct business together.
A transaction will be invalid if the underlying transaction is illegal or if the Merchant fails to adhere to the terms of this Agreement in relation to a transaction.
A transaction will be un-authorised if the underlying transaction was processed through a Pay Terminal that utilises a certificate that was not issued by Sticitt or that has been issued for a different Pay Terminal.
Sticitt reserves the right to disregard un-authorised, invalid and fraudulent transactions or duplicated transactions, subject to confirmation and disclosure by Sticitt that the transactions are invalid.
Until a Sticitt Pay Account is blacklisted, cancelled or blocked by Sticitt, Sticitt shall be obliged to pay the Merchant in terms hereof for all Authorised Transactions, less all applicable fees as agreed to between Sticitt and the Merchant that took place irrespective of any dispute between Sticitt and the Account Holder. Paid transactions do not warrant that the person presenting the transaction through the Payment SDK or Pay Terminal is authorised to do so. It merely confirms that sufficient Sticitt Pay credits are available in the Account Holder’s Sticitt Pay Account. If the Merchant agrees to furnish a refund to an Account Holder, the Merchant must electronically, through a Pay Terminal affect such a refund by reversing the transaction within 48 hours of the successful transaction that gave rise to such refund. Following this time the Merchant must arrange any refund directly with the Account Holder. No cash refund may be made by the Merchant to an Account Holder.
Relating to Pay Terminals, the Merchant can perform refunds to Account Holders by deleting transactions performed at a specific Pay Terminal through that Pay Terminal only and must do so within 48 hours from the original transaction date. Such a refund procedure will transfer Sticitt Pay credits from the applicable Merchant’s Sticitt Pay account to the relevant Account Holder who performed the original transaction. Any charges as part of the original transaction by the Account Holder at the Merchant will remain and will not be reversed as part of the refund process.
In the event of any dispute concerning the amount of any monies payable by a Party to the other under this Agreement, a certificate as to the amount due and payable, audited and signed by the auditors of Sticitt shall be prima facie proof of the amount owing.
The Pay Terminal Activation Fee will be deducted from the Merchant's Sticitt Pay Account upon successful Pay Terminal delivery. The Pay Terminal Monthly Rental Fee will commence in the month immediately following the successful Pay Terminal delivery month. Sticitt reserves the right to charge the Pay Terminal Monthly Rental Fee to a Merchant's Sticitt Pay Account even if sufficient credits are not available. Sticitt also reserves the righ to waive any Pay Terminal Activation Fees or Sticitt Pay Monthly Terminal Rental Fees.
Pay Terminals can be cancelled by sending an email to email@example.com. The applicable Pay Terminal will be de-activated once such cancellation request has been received and confirmed by Sticitt and Sticitt reserves the righ to reclaim and recollect any cancelled Pay Terminals. In cases of successful cancellation, Pay Terminal Monthly Rental Fees will stop the month folliwng the cancellation month but will be charged in full for the month of cancellation.
Additional Pay Terminals can be ordered by contacting Sticitt at firstname.lastname@example.org and by completing and singning the applicable Pay Terminal order form. Pay Terminals remain the property of Sticitt. In the event that a problem, issue or malfunction is reported, Sticitt hereby undertakes to resolve such problems, issues or malfunctions as quickly as is reasonably possible.
Sticitt shall not be held liable for any signal strength issues due to network failure but will advise of alternative solutions if possible and if the solution to be implemented would be beneficial to both Parties. Malfunctioning reports must be provided by sending an email to email@example.com and will only be effective once one of the Sticitt support team members confirms receipt of such report. However, Sticitt shall not be held liable for any Pay Terminal malfunctions caused by the Merchant’s negligence or networking related problems.
Sticitt also reserves the right to charge a call out fee and recover all costs associated with replacing or repairing the Pay Terminal reported as malfunctioning if such malfunctioning was determined to be caused by the Merchant’s negligence or networking related problems. To determine and confirm the root cause and applicable repair or replacement cost, an objective third party chosen by Sticitt will provide a Pay Terminal damage report outlining the root cause of the malfunction and the applicable replacement or repair costs and such report shall be prima facie proof of the Pay Terminal’s malfunctioning root cause and associated repair or replacement cost.
Each party will warrant to the other party that their participation in the Agreement comes without liabilities or claims which may damage or cause harm to the commercial objectives of the Agreement.
Until such time as the Merchant is notified that a Sticitt Pay Account has been blacklisted, cancelled and/or blocked, the Merchant shall, subject to the provisions of “Payments and Refunds” above, not be liable for any losses or damages incurred by Sticitt due to the unauthorised use of a Sticitt Pay Account by a person other than the particular Account Holder. However, and in addition to the provisions of “Payments and Refunds” above, should a Sticitt Pay Account be used fraudulently by an employee of the Merchant then the aggregate value of Authorised Transactions made pursuant to the unauthorized use of a Sticitt Pay Account shall be the responsibility of the Merchant.
The Merchant hereby indemnifies Sticitt against any and all claims, losses, damages and expenses which may be sustained or incurred by Sticitt or for which Sticitt may be sought to be held responsible as a result of or in connection with any act or omission of the Merchant, its employees, agents or representatives arising out of the terms of this Agreement.
The use of Pay Terminals are at the Merchant’s own risk and indemnifies Sticitt against any claims, losses, damages and expenses which may be sustained or incurred by Sticitt or for which Sticitt may be sought to be held responsible as a result of physical injury incurred by the Merchant, its employees, agents or representatives or Account Holders from using any Pay Terminals.
Neither party will be liable to the other for non-compliance with the contracts if caused by a matter beyond the control or anticipation of the party.
If any part of this Agreement is declared unenforceable or invalid, the remainder will continue to be valid and enforceable.
Should any dispute, disagreement or claim arise between the parties (called hereafter “the dispute”) concerning this agreement, the parties shall try to resolve the dispute by negotiation. This entails that the one party invites the other in writing to a meeting to attempt to resolve the dispute within 5 (five) days from the date of the written invitation. If the dispute has not been resolved by such negotiation, the parties shall submit the dispute to AFSA administered mediation, upon the terms set by the AFSA Secretariat. Failing of such a resolution, the dispute, if arbitrable in law, shall be finally resolved in accordance with the Rules of the AFSA by an arbitrator or arbitrators appointed by AFSA. The parties hereby agree that the arbitrator’s decision will be final unless it contradicts public policy.

The Parties shall at all times endeavour to comply with all applicable legislation and regulations. Save as provided for herein, neither Party shall be entitled to cede, delegate, assign or otherwise transfer any of its rights and/or obligations in terms of this Agreement to any third party without the prior written consent of the other Party, which consent shall not unreasonably be withheld. The Parties will cooperate with each other to give effect to the provisions of this Agreement and their relationship shall be governed by the principles of good faith.
We collect “Non-Personal Information” and “Personal Information.” Non-Personal Information includes information that cannot be used to personally identify You, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences You submit and preferences that are generated based on the data You submit and number of clicks. Personal Information includes, but is not limited to Your name, surname, cell phone number, email, work and residential address which You submit to us through the Site or during the registration process to our Service/Product.
In an effort to improve the quality of the Service/Product, we track information provided to us by Your browser or by our software application when You view or use the Service/Product, such as the website You came from (known as the “referring URL”), the type of browser You use, the device from which You connected to the Service/Product, the time and date of access, and other information that does not personally identify You. We implement security measures designed to protect Your information from unauthorized access. Your account is protected by Your account password and we urge You to take steps to keep Your personal information safe by not disclosing Your password and by logging out of Your account after each use. We further protect Your information from potential security breaches by implementing certain technological security measures including encryption, firewalls and secure socket layer technology. However, these measures do not guarantee that Your information will not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software. Sticitt utilises cloud network infrastructure and as such Your personal information could potentially be stored, partially or in full, on servers located outside the borders of South Africa. By using our Service/Product You accept the potentially storage of Your information outside of the borders of South Africa and You acknowledge that You understand and agree to assume these risks.
The Subdomain allows You to submit a Youtube video link ("Youtube Video") and You confirm that You have read and understand the Youtube terms and conditions, as outlined at https://www.youtube.com/t/terms. You further agree to the re-distribution of the Youtube Video to us or any other party we have entered in to agreement to and confirm that You are older than 16 years or that You are the legal parent and/or guardian of any minors in the Youtube Video. You further confirm that You have the consent of all individuals older than 16 years and priovide Your consent for minors that you are the legal parent and/or guardian to to distribute the Youtube Video. In the event that you are not the legal parent and/or guardian of any minors in the Youtube Video you agree that you have the consent of such legal parent and/or guardian to include such minor in the re-distribtuion of the Youtube Video.
Our Merchant App needs to access its device's location services to enable the Bluetooth payment reader to work without interruption. This location services run in the background, even while the app is closed, and tracks the signal from the Bluetooth reader, allowing constant connectivity between the App and the Bluetooth device. The following features will therefore use this service: • Bluetooth Low Energy Connection to the Reader. We do not capture any information regarding the location of the device using this services.
